On Wednesday, May 22, the Supreme Court rejected the petition of former Jharkhand chief minister Hemant Soren. Soren had approached the court to challenge his arrest by the Enforcement Directorate in a money laundering case connected to an alleged land scam in the state. Additionally, he sought interim bail to participate in the Lok Sabha elections 2024.

The Supreme Court grilled Hemant Soren on Tuesday, questioning his ability to dispute the legality of his ED arrest after a Jharkhand trial court had already found prima facie evidence of money laundering against him.

The court highlighted the contrasts between Soren’s situation and that of Delhi chief minister Arvind Kejriwal. Kejriwal had previously been given interim bail in a money laundering case so that he could actively participate in the ongoing Lok Sabha elections.

When Arvind Kejriwal received interim bail on May 10, he did not apply for regular bail from a trial court, and there was no judicial order of cognisance against him in the Delhi excise policy case, as pointed out by a vacation bench. In contrast, a Jharkhand trial court has taken cognisance of the offences under the Prevention of Money Laundering Act (PMLA) against Hemant Soren, based on prima facie incriminating materials, and his bail plea was turned down.
