The Supreme Court, in today’s hearing, announced that it has not yet reached a verdict regarding Delhi Chief Minister Arvind Kejriwal’s interim bail. Furthermore, they mentioned that the case will be revisited on May 7th for further discussion.
Arvind Kejriwal Bail
On Friday, the Supreme Court hinted that it might consider granting interim bail to Arvind Kejriwal, the imprisoned Chief Minister of Delhi. However, it made it clear that no final decision has been reached yet. The court directed the Enforcement Directorate (ED) to seek guidance on the possibility of granting interim bail and the conditions that could be imposed on him.
Towards the end of the hearing on the plea filed by Kejriwal, challenging his arrest by the ED, Justices Sanjiv Khanna and Dipankar Dutta made some verbal remarks.
The bench asked Additional Solicitor General SV Raju, who represented ED, to ensure they are ready to discuss interim bail for him due to the upcoming elections on Tuesday next week (May 7). They requested him to gather necessary instructions on the matter and determine the conditions that should be set. This is to prevent any unexpected developments, they explained.
While the case was being heard, the judges questioned the Enforcement Directorate (ED) and stated, “You have invoked section 70. So, as per your argument, the main culprit is AAP. It is not possible to have two main culprits for a single crime. The Central Bureau of Investigation (CBI) has not pressed charges against him. The investigation was ongoing, but Kejriwal has not been included in the chargesheet.”
Raju made it clear, “Adjudication is not necessary.”
In response, Justice Khanna questioned, “If AAP is the main accused and no adjudication proceedings have started against AAP, can you arrest Kejriwal?”
ASG Raju replied, “Confiscations can happen without adjudication, that’s how the act works.”
Senior advocate Abhishek Manu Singhvi, representing Kejriwal, argued, “Initially, all co-accused in my case remained silent. Then they suddenly started speaking. The actions of a political party cannot always be attributed to its convenor, treasurer, etc.”
